By remitting payment, executing an engagement agreement, approving an invoice, or booking strategic consulting sessions with Gautam Kalal, you explicitly acknowledge, understand, and agree that WE DO NOT OFFER ANY REFUNDS UNDER ANY CIRCUMSTANCES. Please read this policy completely prior to engaging our services.
01 Irrevocable Nature of Custom Digital Work & Consulting
Gautam Kalal provides high-touch, bespoke growth consulting, direct-response copy, funnel architecture, media buying execution, and custom tracking engineering. Unlike physical retail products, specialized intellectual property, advisory time, proprietary conversion methodologies, and technical engineering cannot be un-delivered, returned, or un-consumed once initiated or transferred.
From the moment your onboarding begins, dedicated engineering hours, strategy analysis, and custom asset development are irreversibly committed to your business. Consequently, all fees are earned upon receipt and are strictly non-refundable.
02 Setup Fees, Sprints & Advisory Retainers
Our commercial structure may involve one-time implementation setup fees, sprint fees, or monthly partnership retainers:
- Implementation & Setup Fees: One-time onboarding fees cover comprehensive market research, offer diagnostic, conversion funnel engineering, CRM workflow programming, pixel/CAPI instrumentation, custom creative design, and ad campaign staging. These setup fees are 100% non-refundable under any condition, regardless of whether you choose to launch the staged campaigns.
- Strategic Consulting & Clarity Sessions: All advisory hours, coaching calls, strategy audits, and private sessions are billed for reserved calendar access and intellectual advisory. No refunds, partial refunds, or chargebacks are permitted.
- Sprint & Retainer Payments: Once a sprint commences or a retainer period begins, payments cannot be refunded or retroactively prorated.
03 Third-Party Advertising Budgets & Software Costs
Gautam Kalal does not act as a broker or reseller for advertising networks. All media spend (including Meta Ads, Google Ads, YouTube Ads, LinkedIn Ads, TikTok Ads) is funded directly through the client's own corporate billing profile on each respective ad platform:
Advertising Spend: Under no scenario is Gautam Kalal responsible for reimbursing, refunding, or crediting advertising spend paid to third-party ad networks. Ad spend is consumed in real time by external auction engines and is completely outside our custody.
Third-Party Software & Tools: All subscriptions required for your sales engine—including CRM software, email autoresponders, SMS gateways, WhatsApp Business APIs, hosting providers, domain registrars, and AI API tokens—are billed directly to you and are strictly non-refundable.
04 Clarification on the "Success Guarantee"
Our partnership models may include performance milestones under the headline "If We Fail, You Don't Pay" or "Success Guarantee". It is crucial to understand the exact legal definition of this provision:
The Success Guarantee operates strictly as a conditional waiver of future performance bonus fees or revenue-share fees.
If the agreed-upon qualified pipeline milestones specified in your signed agreement are not achieved despite fulfilling all mutual operational criteria:
- You are NOT charged future performance compensation for that milestone.
- THE SUCCESS GUARANTEE DOES NOT CONFER ANY RIGHT TO A CASH REFUND, restitution, or reimbursement of already-paid setup fees, completed work, consulting retainers, or third-party ad spend.
05 Strict Anti-Chargeback & Dispute Prohibition
By purchasing services or executing an invoice, the client irrevocably covenants that they will not file any chargeback, payment dispute, claim, or reversal with their bank, credit card company, payment processor (e.g. Stripe, Razorpay, PayPal), or financial institution:
Breach of Contract & Fraud Notice: Attempting to reverse or dispute payments for digital services delivered, initialized, or contracted constitutes intentional breach of contract and merchant fraud under applicable civil and criminal statutes.
In the event of an unauthorized chargeback or payment dispute:
- All active services, campaigns, funnel hosting, and software integrations will be terminated immediately with zero notice.
- All intellectual property licenses granted to the client are immediately revoked.
- The client shall be fully responsible for all administrative dispute fees ($500 minimum per dispute), collection agency fees, and all reasonable attorney fees incurred in contesting the chargeback and recovering outstanding liabilities.
- We reserve the right to report non-paying parties and fraudulent chargeback filers to international credit bureaus and commercial delinquency registries.
06 Client Delays, Non-Responsiveness & Early Abandonment
Successful deployment requires prompt client cooperation, including provisioning ad account access, approving copy drafts, providing brand assets, and attending scheduled check-ins.
Failure to respond, internal client rescheduling, changes in client personnel, delays in ad budget funding, unilateral business pivot, or project abandonment by the client does not constitute grounds for a refund, credit, or extension of obligations.
07 Governing Law & Legal Jurisdiction
This Strict No-Refund Policy and all related contractual relationships shall be governed, interpreted, and construed in accordance with the substantive laws of India. Any legal dispute, arbitration, or proceeding arising out of or related to this policy or our commercial engagements shall be subject to the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat, India.
